TERMS AND CONDITIONS OF USE

These Terms and Conditions of use are entered into by and between You and Kornerstone Credit Services, LLC, and its affiliates, with a principal place of business at 406 W. South Jordan Pkwy, Suite 600, South Jordan, UT 84095 (“Kornerstone", “we” or “us”). The following terms and conditions, together with any documents they expressly incorporate by reference (collectively, “Terms and Conditions”), govern your access to and use of kornerstonecredit.com, portal.Kornerstonecredit.com, and dealers.Kornerstonecredit.com (the “Site(s)”), whether as a guest or a registered user.

You should carefully read the Terms and Conditions before using the Site or its lending services. By use of the Site you agree to be bound and abide by these Terms and Conditions and our Privacy Policy, found at https://www.kornerstonecredit.com/privacy-policy, incorporated herein by reference. This is a legally binding agreement. If you do not want to agree to these Terms and Conditions or the Privacy Policy, you must not access or use the Site, including but not limited to its lending services.

This Website is offered and available to users who are 18 years of age or older and reside in the United States or any of its territories or possessions. By using this Site, you represent and warrant that you are of legal age to form a binding contract with the Company and meet all of the foregoing eligibility requirements. If you do not meet all these requirements, you must not access or use the Site.

The advertised transactions are part of a lease-purchase agreement (or in specified states, a lease agreement with an option to purchase; a consumer rental-purchase agreement; a rent-to-own agreement; a consumer lease-purchase agreement). Not available in WI, MN, VT, NJ. Retailer participating locations only. You will not own the merchandise until the total amount necessary to acquire ownership is paid in full or you exercise your Early Buyout purchase option. Ownership is optional. 13. Additionally, you agree not to: (a) Use the Site in any manner that could disable, overburden, damage, or impair the site or interfere with any other party's use of the Site, including their ability to engage in real time activities through the Site, (b) use any robot, spider, or other automatic device, process, or means to access the Site for any purpose, including monitoring or copying any of the material on the Site, (c) use any manual process to monitor or copy any of the material on the Site, or for any other purpose not expressly authorized in these Terms and Conditions, without our prior written consent, (d) use any device, software, or routine that interferes with the proper working of the Site, (e) introduce any viruses, Trojan horses, worms, logic bombs, or other material that is malicious or technologically harmful, (f) attempt to gain unauthorized access to, interfere with, damage, or disrupt any parts of the Site, the server on which the Site is stored, or any server, computer, or database connected to the Site, (g) attack the Site via a denial-of-service attack or a distributed denial-of-service attack, (h) otherwise attempt to interfere with the proper working of the Site.

TO THE FULLEST EXTENT PERMISSIBLE BY LAW, Kornerstone AND ITS SUBSIDIARIES AND AFFILIATES MAKE NO REPRESENTATION OR WARRANTIES OF ANY KIND WHATSOEVER FOR THE CONTENT ON THE SITE OR THE MATERIALS, INFORMATION AND FUNCTIONS MADE ACCESSIBLE BY THE SOFTWARE USED ON OR ACCESSED THROUGH THE SITE, FOR ANY PRODUCTS OR SERVICES OR HYPERTEXT LINKS TO THIRD PARTIES, OR FOR ANY BREACH OF SECURITY ASSOCIATED WITH THE TRANSMISSION OF SENSITIVE INFORMATION THROUGH THE SITE OR ANY LINKED SITE. FURTHER, IN NO EVENT WILL Kornerstone BE LIABLE FOR ANY LOSS OF PROFITS, BUSINESS, USE OF DATA OR FOR INDIRECT, SPECIAL, INCIDENTAL OR CONSEQUENTIAL DAMAGES OF ANY KIND WHETHER BASED IN CONTRACT, NEGLIGENCE OR OTHER TORT. TO THE FULLEST EXTENT PERMITTED BY APPLICABLE LAWS, WE ON BEHALF OF OUR EMPLOYEES, AGENTS, SUPPLIERS, AND CONTRACTORS, DISCLAIM AND EXCLUDE LIABILITY FOR ANY LOSSES AND EXPENSES OF WHATEVER NATURE AND HOWSOEVER ARISING, INCLUDING WITHOUT LIMITATION ANY DIRECT, INDIRECT, SPECIAL, PUNITIVE, OR CONSEQUENTIAL DAMAGES, LOSS OF USE, LOSS OF DATA, LOSS CAUSED BY A VIRUS, LOSS OF INCOME OR PROFIT, LOSS OF OR DAMAGE TO PROPERTY, CLAIMS OF THIRD PARTIES, OR OTHER LOSSES OF ANY KIND OR CHARACTER, EVEN IF WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES OR LOSSES, ARISING OUT OF OR IN CONNECTION WITH THE USE OF THIS THE SITE OR ANY WEBSITE WITH WHICH IT IS LINKED. YOU ASSUME TOTAL RESPONSIBILITY FOR ESTABLISHING SUCH PROCEDURES FOR DATA BACK UP AND VIRUS CHECKING AS YOU CONSIDER NECESSARY.
16. You hereby agree to indemnify, defend and hold Kornerstone, its affiliates, licensors, and service providers, and its and their respective officers, directors, owners, agents, employees, contractors, suppliers, information providers, successors, assigns, and licensees (collectively, the “Indemnified Parties”) harmless from and against any and all liability and costs incurred by the Indemnified Parties in connection with any claim arising out of any breach by you of these Terms and Conditions or the foregoing representations, warranties and covenants, including without limitation, attorneys’ fees and costs. You shall cooperate as fully as reasonably required in the defense of any claim. Kornerstone reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you and you shall not in any event settle any matter without the written consent of Kornerstone.
17. Where we provide hypertext links from or to third party sites, we do so for convenience and information purposes only. We do not review, endorse, approve or control, and are not responsible for any sites linked from or to the Website, the content of those sites, the third parties named therein, or their products, resources or services. Linking to any other site is at your sole risk and we will not be responsible or liable for any damages in connection with linking, and we accept no liability nor make any endorsement or approval of the same.
18. These Terms and Conditions and our Privacy Policy contain the entire understanding between us with respect of the Site and supersede and no representation, statement, inducement oral or written, not contained herein shall bind either of us. Kornerstone reserves the right, at its sole discretion, to change, modify, add or remove any portion of these Terms and Conditions, in whole or in part, at any time. Notification of changes in these Terms and Conditions will be posted on the Site. Your continued use of the Site following the posting of revised Terms and Conditions means that you accept and agree to the changes. You are expected to check this page from time to time so you are aware of any changes, as they are binding
19. The terms and conditions of use in this Terms and Conditions are subject to change at any time. You should review the Terms and Conditions regularly for any changes.
20. Should any part of the Terms and Conditions be declared invalid or unenforceable by a court of competent jurisdiction, such declaration shall not affect the validity of any remaining portion and such remaining portion shall remain in full force and effect as if the invalid portion of the Terms and Conditions had been eliminated.
21. The Site, any information provided from it and the Terms and Conditions are given and made in the state of Utah, United States of America. We provide this Site for use only by persons located in the United States. We make no claims that the Site or any of its content is accessible or appropriate outside of the United States. Access to the Site may not be legal by certain persons or in certain countries. If you access the Site form outside the United States, you do so on your own initiative and are responsible for compliance with local laws. THIS TERMS AND CONDITIONS AGREEMENT SHALL BE GOVERNED BY AND CONSTRUED IN ACCORDANCE WITH THE LAWS OF THE STATE OF UTAH, WITHOUT REGARD TO CONFLICTS OF LAWS PROVISIONS. SOLE AND EXCLUSIVE JURISDICTION FOR ANY ACTION OR PROCEEDING ARISING OUT OF OR RELATED TO THIS TERMS AND CONDITIONS AGREEMENT SHALL BE AN APPROPRIATE STATE OR FEDERAL COURT LOCATED IN SALT LAKE COUNTY IN THE STATE OF UTAH.
22. No waiver by Kornerstone of any term or condition set out in these Terms and Conditions shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure of Kornerstone to assert a right or provision under these Terms and Conditions shall not constitute a waiver of such right or provision. If any provision of these Terms and Conditions is held by a court or other tribunal of competent jurisdiction to be invalid, illegal, or unenforceable for any reason, such provision shall be eliminated or limited to the minimum extent such that the remaining provisions of the Terms and Conditions will continue in full force and effect.

MOBILE TERMS OF SERVICE:

1. Kornerstone may send SMS messages from time to time with important information regarding your account or with offers and marketing information that you have opted into.
   
   2. You can cancel the SMS service at any time. Just text "STOP" to the short code. After you send the SMS message "STOP" to us, we will send you an SMS message to confirm that you have been unsubscribed. After this, you will no longer receive SMS messages from us. If you want to join again, just sign up as you did the first time and we will start sending SMS messages to you again.
   
   3. If you are experiencing issues with the messaging program you can reply with the keyword HELP for more assistance, or you can get help directly at support@kornerstonecredit.comor by calling 888-521-5111.
   
   4. Carriers are not liable for delayed or undelivered messages
